This is VMRC's April 29, 2026 email stating its jurisdictional conclusion for Project Loch.
Why it matters
This is one of the few direct agency position letters in the archive. It records that VMRC concluded the proposal, as submitted to it, did not fall within that agency's jurisdiction.
What the document says
VMRC states that no authorization from that agency would be required for the proposed data center campus and associated components. The message also notes that authorization from DEQ and/or USACE might still be needed and says the application was forwarded to those agencies.
What it does and does not establish
This letter establishes VMRC's stated jurisdictional position. It does not mean the project was exempt from all environmental review, and it does not resolve DEQ or USACE permitting questions.
