One-page summary of the applicant's response package on compensatory mitigation.

What this document is

This July 2, 2026 package includes the transmittal email and the applicant's written responses to DEQ's fourth additional-information request.

Why it matters

This is the clearest document in the archive showing a change in the mitigation approach. It responds directly to DEQ's request for analysis of permittee-responsible mitigation versus mitigation-bank or in-lieu-fee credits.

What the document says

The response states that the applicant had revised its compensatory mitigation approach and had determined that permittee-responsible mitigation would no longer be pursued. Instead, the response says mitigation requirements would be satisfied through credits from approved mitigation banks or an in-lieu-fee program. The package also includes credit-availability and mitigation-plan material identifying 9.11 wetland credits and 3,119 stream credits through named mitigation banks. This addresses how impacts would be compensated, not where the main project is located.

What it does and does not establish

This is an applicant response, not an agency approval. It establishes what the applicant represented to DEQ at that point in review. It does not establish that regulators accepted every aspect of the revised mitigation approach, but it is the document that sets up the July 8 follow-up asking whether the Wauford SSWD should be withdrawn.
